HOW CONSUMER LAW RELATES TO THIS WARRANTY

THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE (OR BY COUNTRY OR PROVINCE). OTHER THAN AS PERMITTED BY LAW, LUXDIUM DOES NOT EXCLUDE, LIMIT OR SUSPEND OTHER RIGHTS YOU MAY HAVE, INCLUDING THOSE THAT MAY ARISE FROM THE NONCONFORMITY OF A SALES CONTRACT. FOR A FULL UNDERSTANDING OF YOUR RIGHTS YOU SHOULD CONSULT THE LAWS OF YOUR COUNTRY, PROVINCE OR STATE.


WARRANTY LIMITATIONS ARE SUBJECT TO CONSUMER LAW

TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY AND THE REMEDIES SET FORTH ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED. LUXDIUM DISCLAIMS ALL STATUTORY AND IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS, TO THE EXTENT PERMITTED BY LAW. IN SO FAR AS SUCH WARRANTIES CANNOT BE DISCLAIMED, LUXDIUM LIMITS THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THIS EXPRESS WARRANTY AND, AT LUXDIUM’S OPTION, THE REPAIR OR REPLACEMENT SERVICES DESCRIBED BELOW. SOME STATES (COUNTRIES AND PROVINCES) DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY (OR CONDITION) MAY LAST, SO THE LIMITATION DESCRIBED ABOVE MAY NOT APPLY TO YOU.


WHAT’S COVERED 

Luxdium warrants your Luxdium branded product(s) against defects in materials and workmanship when used normally in accordance with Luxdium’s published guidelines for a period of TWO (2) YEARS from the date of original purchase from the end-user purchaser (“warranty period”). Luxdium's published guidelines include but are not limited to user manuals and service communications present on its website or other platforms. This warranty is non-transferrable.


WHAT’S NOT COVERED

This warranty does not apply: (a) to consumable parts, which will diminish over time, unless the failure has occurred due to a defect in materials or workmanship; (b) to cosmetic damage, including but not limited to scratches and dents unless failure has occurred due to a defect in materials or workmanship; (c) to defects present with non-Luxdium branded product(s) used in conjunction with Luxdium branded product(s); (d) to damage caused by abuse, accident, earthquake, fire, negligence, misuse, or other external cause; (e) to damage caused by operating the Luxdium product outside of Luxdium’s published guidelines; (f) to damage caused by modifications performed by anyone who is not a representative of Luxdium; (g) to defects caused by normal wear and tear or otherwise due to nominal aging of the Luxdium product. (h) If the product is proven by relevant authorities to be stolen; or (i) you cannot prove in any way that you are the authorized user of the product (eg. by furnishing proof of purchase).


YOUR RESPONSIBILITIES 

You should perform regular maintenance on your light fixture(s) to ensure no salt or dust accumulates on their enclosure(s) or lenses and run your fixture(s) in a well-ventilated area free of salt spray or elevated humidity. Mesh Fan Covers may be cleaned with a moist paper towel on a weekly basis or as needed. Lenses must be kept clear of saltwater splashes and away from surfaces which may be combustible. The fixture lenses focus light, therefore, setting up a light while the lens is obstructed by a surface is not recommended. Saltwater spray coupled with heat is known to cause lenses to melt. While LUX Engine dissipates heat faster than the factory modules, we still recommend inspecting lenses regularly, and cleaning lenses with a microfiber cloth moistened with RODI or distilled water should any saltwater accidentally spray on the lenses. Keeping lights away from splashing water and elevated at a minimum height of at least 9 inches or 22.86 centimeters is recommended. Additionally, a lid may shield the lenses from occasional saltwater spray. Lens melt or damage to electronics due to salt exposure is not covered by this warranty. 

Do not attempt to desolder any component(s) from the LED modules or remove any primary optics from the LEDs. Doing so may cause irreparable damage, which is not covered by this warranty. 


HOW WE WILL MAKE THINGS RIGHT

If during the Warranty period, you submit a claim to Luxdium in accordance with this warranty, Luxdium, at its will, at its option: (i) repair the Luxdium product using new or parts that are equivalent or superior in performance and reliability, replace the Luxdium product with the same model (or with your consent, a product that has similar functionality) formed by parts that are new or used that are equivalent or superior in performance or reliability, or (iii) exchange the Luxdium product for a refund of your purchase price.

Luxdium may request that you replace user-installable parts or products. A replacement part or product, including any user-installable part that has been installed in accordance with the instructions provided by Luxdium, assumes the remaining warranty of of the Luxdium Product or thirty (30) days from the date of replacement or repair, whichever provides longer coverage for you. When a product or part is replaced, any replacement product becomes your property and the replaced or refunded product becomes Luxdium’s property.

LIMITATION OF LIABILITY

(i) Entire agreement:

Other than consumer law rights which you are entitled as set out at the beginning of this document, all other terms not set out in this warranty are excluded from coverage. Some jurisdictions do not allow limitations and thus the limitations described above may not apply to you.

(ii) Limitation  

In no event shall Luxdium be liable for:

Any losses that were not caused by the breach of this document. Any loss that was not, at the time of purchase of the product, reasonably foreseeable. Any losses relating to business, profits, or loss of opportunity.

Any limitations of liability in this warranty document shall not apply to (i) death or personal injury pursuant to any mandatory law on product liability; (ii) fraud or fraudulent misrepresentation; (iii) intentional misconduct or gross negligence; (iv) or a culpable breach of major contractual obligations. A damages claim based on a breach of major contractual obligations or gross negligence will be limited to foreseeable damage typical for the sale contract concerned.
